In compliance with the provisions of Law 34/2002 of July 11, 2002, on Information Society Services and Electronic Commerce (LSSICE), these provisions regulate the use of the service of the Website https://abervian.es/, (hereinafter "Website") that Abervian S.R.L. makes available to Internet users.
Access to the Website is free of charge except for the cost of the connection through the telecommunications network provided by the access provider contracted by the users. Certain services are exclusive to our clients and their access is restricted. The services provided by Abervian S.R.L. in general have the price (VAT not included) indicated in the corresponding service proposal and in no case are offered or provided through the portal service.
In those cases and sections where our Website offers e-commerce services subject to contracting or economic consideration, the General Contracting Conditions specified in each case must be accepted.
The use of the Website confers the condition of Website user (hereinafter, User) and implies acceptance of all the conditions included in this Legal Notice. The provision of the Website service is limited to the time when the User is connected to the Website or any of the services provided through the same. Therefore, the User must carefully read this Legal Notice each time he/she intends to use the Website, since the Website and its conditions of use contained in this Legal Notice may undergo modifications.
Some Website services accessible to Internet users or exclusively for Abervian S.R.L. customers may be subject to special conditions, regulations and instructions which, where applicable, replace, complete and/or modify this Legal Notice and which must be accepted by the User before the corresponding services are provided.

All the elements that make up the Website, including but not limited to texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its structure, graphic design, source codes, logos, trademarks and other distinctive signs that appear on it, are owned by Abervian S.R.L. or its collaborators and are protected by the corresponding intellectual and industrial property rights,
The owner of the Web site (Abervian S.R.L.) expressly prohibits framing or the use by the User or third parties of any other mechanisms that alter the design, original configuration or contents of our Web site.
The use of the contents must respect its particular licensing. Therefore, its use, reproduction, distribution, public communication, transformation or any other similar or analogous activity is strictly forbidden without the prior and express authorization of the owner of the website, Abervian S.R.L..

The purpose of the Website is to provide the general public with information about the activities that this organization carries out and the products and services it provides, for the development of its activity.

Abervian S.R.L. accepts no responsibility for decisions taken on the basis of the information provided on the Website or for any data and damages caused to the User or third parties as a result of actions based solely on information obtained from the Website.
The information is subject to possible periodic changes without prior notice of its content for expansion, improvement, correction or updating of the contents of the Website.
5.2. THE QUALITY OF THE WEBSITE SERVICE
Access to the Website does not imply any obligation on the part of Abervian S.R.L. to check for the absence of viruses, worms or any other harmful computer element. It is up to the User, in any case, the availability of adequate tools for the detection and disinfection of harmful computer programs.
Abervian S.R.L. is not responsible for any damage caused to the computer equipment of Users or third parties during the provision of the Website service, nor for the malfunctioning of the Web browser or the use of non-updated versions of the same.
5.3. SERVICE AVAILABILITY
Access to the Website requires services and supplies from third parties, including transport via telecommunications networks whose reliability, quality, continuity and operation is not the responsibility of Abervian S.R.L.. Consequently, the services provided through the Website may be suspended, cancelled or become inaccessible, prior to or simultaneously with the provision of the Website service.
Abervian S.R.L. shall not be liable for damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Website service during or prior to the provision of the same.
5.4. DISCLAIMER AND LIMITATION OF LIABILITY.
The Website access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, Abervian S.R.L. acts as an intermediary service provider in accordance with article 17 of Law 34/2002, of July 12, 2002, on Information Society Services and Electronic Commerce (LSSICE) and shall only be liable for the content and services supplied on the Linked Sites to the extent that it has actual knowledge of the unlawfulness and has not deactivated the link with due diligence.
In the event that the User considers that there is a Linked Site with unlawful or inappropriate content, he/she may notify Abervian S.R.L. in accordance with the procedure and effects established in clause 7, without this notification in any case entailing the obligation to remove the corresponding link.
In no case, the existence of Linked Sites should presuppose the existence of agreements with the responsible or owners of the same, nor the recommendation, promotion or identification of Abervian S.R.L. with the manifestations, contents or services provided.
Abervian S.R.L. has no knowledge of the contents and services of the Linked Sites and therefore accepts no liability for any damage caused by the unlawfulness, quality, failure to update, unavailability, error or uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly attributable to Abervian S.R.L.

In those cases where personal data is collected, processed or stored, this will be done in accordance with the Privacy Policy published on the Website, which can be consulted at the footer of the Web site.

The Website uses cookies in accordance with the provisions of our Cookies Policy, which can be found in the footer of the Web site.
8. REPORTING OF ACTIVITIES OF AN ILLEGAL OR INAPPROPRIATE NATURE
In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose contents or services are illicit, harmful, denigrating, violent or contrary to morality, he/she may contact Abervian S.R.L. indicating the following points:

The receipt by Abervian S.R.L. of the communication provided for in this clause shall not imply, in accordance with the provisions of the LSSI, actual knowledge of the activities and/or contents indicated by the communicating party.
Likewise, the title accrediting the legitimacy of the holder of the rights and, if applicable, that of representation to act on behalf of the holder when it is a person other than the communicating party, must be provided.
9. MODIFICATION OF THE LEGAL NOTICE
In order to improve the performance of the Web site, Abervian S.R.L. reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on the Web site, to the configuration and design of the site and to this legal notice, as well as to any other particular conditions. 10. JURISDICTION
Abervian S.R.L. reserves the right to bring any civil or criminal action it deems necessary for improper use of the Website and its Contents, or for failure to comply with the present conditions of the Legal Notice.
For any questions that may arise regarding the interpretation, application and compliance with this Legal Notice, as well as any claims that may arise from its use, all parties involved shall submit to the ordinary jurisdiction, submitting themselves to the Judges and Courts that correspond according to law.
